Here, read this. “Understanding The Role #Mycotoxins Play In #Mold #Remediation Projects”
https://lnkd.in/gDGmXqsu

Can anybody explain to me why State Farm ® would allow assigned #preferredvendors to destroy my home, & cause it to become 90% contaminated – throughout the house – with life threatening microbial growth?

Why would #StateFarm #AZ #intentionally order and pay for an inadequate report to authorize build back without remediation? They spent $101,000 in 2019, just to cover up the crimes, negligence, intentional misrepresentation etc of their Adjusters and their Preferred Vendors?

65% of the house demolished in 2019, but not remediated. In 2020, 85-90% of the house was demolished, mostly remediated, but not completely.
I lived in it thru #Lockdown2020

HOW CAN AN INSURANCE COMPANY PROFIT BY DESTROYING HOMES AND THREATENING THE VERY LIFE OF THIER POLICY HOLDER, ON PURPOSE.

THE MORE ABUSE I GET FROM DEFENSE COUNSEL, THE MORE I THINK I MADE A MISTAKE IN FILING CIVIL LITIGATION. IT’S BEGINNING TO LOOK LIKE EXTREME CRIMINAL RACKETEERING

Are there any #lawyers in America left that give a hoot about Justice and the American People?

I’m trying to prepare for another lawfare hearing & a series of discovery & other abuses by defense counsel for one of the environmental inspection/reporting companies with their only defense is that their client provided State Farm with the “mold clearance report” that was requested by adjusters in order to authorize build back.

Counsel suggests that if State Farm ® cheaped out & ordered a test that would not properly & adequately assess current mold from 40 days of unabated water intrusion & unremediated #waterdamage, so what. He compared it to a chevy vs a mercedes or something like that

The thing is, THAT IS NOT HOW SCIENCE WORKS.

Counsel says both of his client’s reports are just a snapshot of readings for that day.

And so what if reports before & after illustrate and evidence increasing microbial growth, identified medically as life threatening  at 10 months.

Nevermind that their reports say ‘if there is visible evidence of mold, call us back, pdq’ – For the second report, they recommended $10,000 in surface cleaning and forgitabout sources of mold contamination for a while longer.

I HAVE TO FIGHT IN COURT WHEN EVERYBODY KNOWS THAT STATE FARM AND OTHERS DO THIS TO AMERICANS ALL THE TIME? WHY DOES #CDOI SUPPORT SUCH CONDUCT? WHY DO AMERICANS ACCEPT SUCH CORRUPTION??  ?????

That’s a picture from last winter. I lived in the house like that, for over a year. I recently learned that it was considered “uninhabitable” but I couldn’t get State Farm adjusters back out, and with the lock down, I couldn’t find a Contractor to do the build back after the second demolition.
What a mess. It was sooooooooooooooooo COLD… It snows here… I learned the value of insulation and dry wall last year. Some of the remediation guys seem to think that a little KILZ white paint is remediation? Go figure! At least they didn’t say, “SPRAY IT WITH BLEACH, LADY, SOLVES EVERYTHING!”

My State Farm ® agent, #BobDunn, RIP, couldn’t be bothered to help me as I reported regularly to his office that, “OMG, the Arizona #ClaimsOffice sent goons out to destroy my home. Look what they have done! [showing pictures from my iphone, tearfully]

The office manager even called the adjuster on my behalf since I was get to no responses. She finally made an appointment for me to meet with Bob. Bob was a real jerk. He said he was too busy to help me, busy writing ‘#FirePolicies for Californian’s who had been cancelled by other carriers. He told me to #LawyerUp and sue for a million dollars. I said, “I can’t find a lawyer and I don’t need a million dolllars. Nobody will represent me!” He said, ‘You’re right Linda. That’s how lawyers are. Sue for $10 million, tell the lawyers you only need a million and they can have $9 million”….

I told him how Paul Davis Restoration caused the roof replacement to be delayed, demanded cash if I wanted it fast, then organized a fast dirty pack-out 10 days later, destroying all my household goods. More to that story. I told Bob, “they are the “Adjuster Representative” and Bob snarled at me and said, ‘I DON’T KNOW WHAT THAT IS. WHAT IS AN ADJUSTER REPRESENTATIVE” I said, “I don’t know, that’s what his reports say at the top. The State Farm adjuster hasn’t shown up… PDR is the general contractor assigned by Contractor Connection and SERVPRO put the tarp on and is supposed to be doing the water damage remediation.’

#PDR told me if I wanted a #moldclearance, to tell #ServPro#ServPro apparently abandoned the project, per State Farm, on 2/19/2019 – claiming it was complete (but there was still no roof, still storms, and #TheTarp never worked) ServPro asked adjuster if they should get a mold clearance. #StateFarm got one from @AmericanEnviornmentalGroup – and all subsequent reports suggest that both the AEG March 2019 and August 2019 were FALSE. But, they gave State Farm what they asked and paid for — a mold clearance upon which the cover up build back was authorized.

Certain members of defense counsel threaten me often… they also say that telling the truth publicly is somehow defamatory. TRUTH IS THE DEFENSE FOR THAT.

I left Bob’s office in tears, and you’re read the story of what has happened since 2/2019. Shortly thereafter a friend called and read me Bob obituary. I guess he had been sick… still no excuse for his callous disregard for a #StateFarm policyholder of many decades.

Great Question, Scott Greene! Maybe some Public Adjusters and IEP’s and that crowd might jump in with more detail than I can provide… but, here goes:

If you read the original post — https://www.linkedin.com/posts/lindaayres31111_understanding-the-role-mycotoxins-play-in-activity-6891502354915573760-IFqM – it deals with THE ROLE MYCOTOXINS PLAY IN MOLD AND REMEDIATION PROJECTS. C&R Magazine is a top industry publication.

Adjusters rely on the input from environmental companies like AEG regarding claims handling.

Testing companies perform a variety of tests, dependent on particulars of a loss, like water damage duration and locations, roof loss, remediation and risks of seen and unseen microbial growth.

Some experts in the State Farm preferred vendor program suggest that mold usually becomes a problems with 24-72 hours.

At my place, it was simply shocking that in March 2019, one vendor found not even one itty bitty mold spore. In August 2019, the same vendor found just a few itty bitty spores. They suggested a $10,000 surface cleaning, and nevermind the sources of mold, if the mold was behind the walls, it’s out of sight, no problem.

Joey, another State Farm adjuster, said, “YOU HAD WALLS IN NOVEMBER 2019!” He couldn’t grasp that those walls that were to have been demolished in February 2019 by ServPro, that they were not demolished despite having been identified as water damages, and they had become toxically contaminated with all sorts of species of microbial growth.
You know, the ‘can’t see it, can’t prove it’ mentality that the microbial growth had anything to do with wind storm, roof blow off and nearly 40 days of unabated water intrusion, incomplete demolition and zero remediation in February 2019. Can you imagine a blizard in February 2019 and no roof?

It was a miracle that the sheathing didn’t cave in. Maybe it was the painter’s plastic tarp that helped save the sheathing? We can ask Gary on February 2nd. He might know. It’s not really that complex about mold.

For example, at the State Farm Arizona Claims office, Roy Paynter, the adjuster with the public deposition, (As you know, I have also blogged about) — but, Roy has adjusters under him who think that 40 days of unabated water intrusion from, say 2/2/2019- mid-March 2019 requires only a ‘dryout’ of knocking down half the walls identified as water saturated, having some air movers on site for half the allocated time and half the allocated cost, without remediation and without a roof replacement for over a month is sufficient to prevent or mitigate toxic microbial growth. That’s just silly.

AEG, as part of it’s duties in the State Farm Preferred Vendor Program, would surely correct such a silly assumption to ensure that the desk adjusters don’t make costly mistakes, that can inflate a simple $10,000 roof loss to a catastrophic loss.

In my case, State Farm paid out over $101,000 on a premature build-back that simply covered up mold and other contaminants…. The records show that the walls identified as water saturated were not demolished in 2019, nor was there any evidence of any chemical remediation.

Other Preferred Vendors include Contractor Connection – a “TPA” that assigned Paul Davis Restoration as the “General Contractor” and “Adjuster Representative.”

SERVPRO, is part of the Preferred Vendor pool of contractors, but they were dispatched directly by State Farm Arizona claims office. They were pre-authorized to spend up to $15k in dry out; they cut out early (allegedly on 2/19/2019, before a HUGE SNOW STORM… but told the Adjuster they completed the job.) How they completed the job without a replaced roof is one of the legal mysteries, huh?

AEG is one of the State Farm top tier Preferred Vendors for mold clearance reports? Jay Barkley is the CEO. I would guess he might be pals with Michael Tipsord, Chairman at State Farm [they have some RICO challenges in Texas, that must keep him sort of awake at night]

Based on the AEG website, “We have an extensive client base that includes insurance carriers, real estate companies, commercial property management companies, restoration specialists, construction companies, government agencies, private homeowners, and more.”

So they sure have a lot of people relying on their expertise, huh?

Here’s the AEG website page on #Mold – Notice the Initial Mold Assessment and Post Remediation Mold Inspection. https://www.americanenv.com/environmental-consulting-services/mold/

Since, through discovery, it was discovered that ServPro did no remediation in February 2019, although they were authorized to by State Farm, to spend up to $15K, and only billed about $7K, but isn’t it odd that AEG might not have questioned further about the extent and duration of water intrusion, and why some water saturated walls had not be demolished?

    Note: “…Developing Dependable Remediation Solutions
Toxic mold is a serious threat to all types of building owners and managers. Mold can grow in a wide range of different locations under varying conditions, and detecting it can often be difficult until it’s too late. If left unaddressed for too long, a major infestation can take root, which usually requires a serious remediation effort to clear. In some cases, toxic mold can put dangerous levels of harmful, undetectable spores into the air, leading to all kinds of major health problems.

At American Environmental Group, we understand how harmful mold can be, and we know just how important it is to eradicate it quickly and effectively. Our Mold Surveys are thorough, accurate, and conducted using the highest-quality mold detection equipment.”

So, if the State Farm adjusters were oblivious to consequences of water damage, they probably relied on American Environmental Group’s environmental expertise to perform the necessary testing for “mold clearance” in order to authorize build back. With a client list as extensive as AEG purports to have, they sure couldn’t get away with letting State Farm adjusters make $10 million mistakes, now could they?

Thanks for your question, I hope that helps. Please do read the full blog…. it’s an act of Love for America. I’m not the only one experiencing these challenges with insurance carriers.

You probably also realize that we have a NATIONAL MOLD CRISIS in America…I have my suspicions about why. It’s a silent killer… I’m not going out quietly, as you know. I might have to make this a blog… it got too long!

    See you in Court Thursday.

PS Yes, I am taking your suggestion seriously about a TED Talk, thank you. I think they have mini ones. As mentioned, I might also get to Toastmasters so I can present in front of the Judge without word-finding challenges and brain-freeze.

Disabilities can be challenging, but challenges can be OVERCOME.

I intend to learn more about publicity, press releases, publicity and book publishing too.

Gotta run. Got a CIVIL LITIGATION paralegal course up in a minute. I must figure out how to properly respond to all the lawfare paper attacks that have been bombing me for months.

I guess the ones I did, I didn’t do right enough… Did you read that 100 page thing I filed for our 11/22/2021 hearing? I guess I named it incorrectly; my answers to Thursday’s questions are all there, and my objections.

I might not win the lawsuit, but it’s not about me. It’s about AMERICA.

PS CHECK OUT AEG’S PAGE ON MOLD… https://www.americanenv.com/environmental-consulting-services/mold/

[You might pass it on to Dominic Tomaino and Michael McGuire, State Farm defense counsel in Ayres vs State Farm et al, and explain to them how AEG perhaps mis-led or failed to advise the State Farm Arizona adjuster team of the consequences of that much water damage for over a month without a roof, multiple storms, only partial demolition and no remediation might have not been the wisest decision of the Roy Paynter adjuster team since February 2019.

Here’s his deposition again….where Roy clearly admits that he and his team HAVE A DUTY TO HELP THE INSURED… [not a duty to destroy their homes and health]
