Why does State Farm hate ALL Americans? 

How do they get away with destroying our homes and health?  I ain’t black, is that why?

Quick question — do you think the State Farm response below is appropriate to send to someone who has been disabled, with a brain injury, from a workplace injury since 2012 and rendered almost homeless because of apparent insurance corruption and racketeering?

DEMOGRAPHICS MATTER

For a $5,000 TO $10,000 roof claim with loss of use and household goods damages — State Farm paid out over $101,000 to cover up the crimes of their adjusters and dispatched/assigned Preferred Vendors.

The roof loss was reported to State Farm within 60 minutes of the event.

The Disabled Elderly woman disclosed her disabilities and asked what the process was. She was told she had to use State Farm Vendors and was given numbers to call. She left messages at each vendor and called State Farm back and said, ‘Nobody answered. I left messages. The rain is pouring in. What’s next?”  NOT ONCE DID THEY SAY CALL A ROOFER. 

IN FACT, THE STATE FARM PREFERRED VENDOR CALLED A LOCAL ROOFER ON 2/4/2019, WHO CAME TO THE PROPERY ON 2/4/2019 AND GAVE THE PREFERRED VENDOR AN ESTIMATE OF $5,000.  THE PREFERRED VENDOR SAID IF THE INSURED WOULD PROVIDE $7,000 CASH, A ROOF COULD BE REPLACED QUICKLY [APPARENTLY  CIRCUMVENTING STATE FARM POLICIES/PROCEDURES, SPLITS] 

THE VENDOR FAILED AND REFUSED TO REPLACE THE ROOF FOR APPROXIMATELY 40 DAYS, BEING THE PROXIMATE CAUSE OF 40 DAYS OF UNABATED WATER AND SNOW INTRUSION. THE CRIMINAL CONDUCT WAS REPORTED REPEATEDLY TO THE ADJUSTER WITH PLEAS FOR HELP BECAUSE THEY WERE DESTROYING THE PROPERTY.

DETAILS THROUGHOUT. 

FINALLY INSURED OBTAINED AUTHORIZATION FOR THE PREFERRED VENDORS TO BE DISMISSED AND REPLACED.  THE ADJUSTER TOLD THE INSURED THAT SHE COULD NOT CALL THE LOCAL ROOFER (WHO SHE WOULD HAVE CALLED ON 2/2/2019 HAD SHE NOT BEEN TOLD SHE WAS REQUIRED TO USE STATE FARM VENDORS) — The adjuster said it would not be ethical to call the local roofer because of commissions to the Preferred Vendor.  CAHOOTS! 

READ ON….THIS STORY IS NOT AT ALL UNIQUE.  IT’S NOT A RACE ISSUE.  IT IS A PATTERN OF PRACTICE AND ABUSES OF VULNERABLE POLICY HOLDERS BY UNSCRUPULOUS ADJUSTER AND TEAMS OF CROOKED PREFERRED VENDORS.  

JUSTICE IS COMING.

I have reached out to the legal community, the Brain Injury Litigation community on LinkedIn, the Remediation and Restoration Communities, Public Adjusters, the CSLB – Contractor State Licensing Board, the California Department of Insurance and the National Association of Insurance Commissioners.  The most helpful and the kindest responses and help have been from the Remediation and Restoration communities., and I am grateful.

Quick question — do you think the State Farm response below is appropriate to send to someone who has been disabled, with a brain injury, from a workplace injury since 2012? 

Notice the threat that they won’t even speak to me on the phone.  They’ve never heard of ADA accommodations with the public?

They’ve recorded many calls, and even the one to the Office of Michael Tipsord was also recorded — and I was I could not have a copy unless approved by management.  Management reportedly denied providing me with a copy. Then, they changed the story to say it was not recorded by their third party complaint desk (contrary to what I was told before the call started)

You have again told us that you might record our telephone conversations. We continue to
object to any such recordings and believe that it is unlawful for you to record without our
consent. Because you write that you might record without any further notice, all of the future
communications between us must be in writing.

The story of mishandling of my claim has been told repeatedly to State Farm and to any and all who would listen. They can’t even keep the records straight if a claim is open or closed, or when the statute of limitations is up.  Obfuscation is their game, no question.

When I first communicated with the writer of the State Farm communication below months ago, he told me he had to speak to the adjuster staff to get familiar with the case.  Since I’ve told the story to them all multiple times, and since they switch adjusters and managers, I graciously sent him a copy of the transcript, so we could all stay on the same page.  He was most ungrateful.  I guess paper trails bother adjusters?  

So, because I refused to participate in insurance fraud, which I reported immediately to the Adjuster assigned, I lost my home and health.  The Preferred Vendors were dispatched, assigned, coordinated by, authorized and negotiated with BY THE ADJUSTER.  THEY WOULD HARDLY SPEAK TO ME.  THE ASSIGNED GENERAL CONTRACTOR DEMANDED, ON 2-4-2019, $7,000 CASH IF I WANTED A ROOF FAST. THE LOCAL ROOFER WAS APPARENTLY WILLING TO REPLACE THE ROOF THAT FIRST WEEK, FOR $5,000.  The GC apparently wanted a fast $2k easy-peasey PROFIT for CALLING THE SAME ROOFER I WOULD HAVE CALLED HAD STATE FARM NOT TOLD THAT THEIR VENDORS WERE TO BE USED. 

So, the General Contractor/”State Farm Adjuster Representative”  was apparently attempting to cheat their referring parties out of commissions and profits, finally provided an xactimate estimate in early March 2019 — TO THE ADJUSTER.  I WAS TOLD THEY COULD NOT DISCUSS IT WITH ME UNTIL IT WAS APPROVED (weeks after I declined to be extorted of $7,000 and I refused to participate in the apparent kick-back scam. Bills were sent directly to the adjuster, and amounts not discussed with the insured.  There’s more to that, for next year. 

Why should a simple $5,000 roof replacement take over 40 days, and destroy all the household goods, and all the standing walls?  That’s a horrible way to make a profit, and it’s extreme elder abuse and racketeering, in my humble opinion, but I’m not a lawyer.

All their advertising talks about how important it is to dry out and remediate water damage within 72hours OR ELSE BIG PROBLEMS WITH MICROBIAL GROWTH – TOXIC STUFF.  I won’t burden you, Dear Reader, with ugly pictures of mold mycotoxin toxicity — but they willl be available in Court.  MONSTERS!   THEY DID NOT REMEDIATE, THE DIDN’T EVEN DEMOLISH ALL THE DRY WALLS THAT WERE IDENTIFIED BY THE VENDORS AS WATER SATURATED.   THE ADJUSTER SUGGESTED THAT AIR BLOWERS WERE SUFFICIENT FOR 40 DAYS OF PRACTICALLY NON-STOP WATER INTRUSION….. BECAUSE I HAD NO ROOF AND THE TARP WAS USELESS FROM DAY ONE.

One of the vendors said there was no crime since I didn’t give them any money.  Wow!  That’s like a bank robber telling the police that there was no crime because the heist was foiled!  D’oh!

The story goes on and one — I am working on making it more concise for the New Year.  The General Contractor and Remediation/Demo team were finally authorized for dismissal on or about March 7, 2019.  

I’m freezing in this house that only has walls, insulation, flooring and fixtures in the kitchen.  State Farm paid out $101,000 on the $5,000 roof – NOT TO RESTORE MY HOME TO PRELOSS CONDITION, BUT TO COVER UP THE CRIMES BY THEIR ADJUSTER TEAM AND PREFERRED VEDORS.  They gave me $8,000 for my destroyed household goods, and might give me another $14,000 if I replace some things (but I have no place to put them, since my house was destroyed because of State Farm and their collusion with their crooked vendors — Some say that adjusters are fired immediately for what they call… skimming or something like that, when they work in cahoots with vendors to inflate costs, and sometimes get cash payments.  Looks like criminal investigations are required, but again, “I ain’t black” and “I ain’t no lawyer.”

I am an unmarried, disabled, female rural homeowner — and I fit the profile of one of the State Farm know target populations, according to some lawyers who have battled with State Farm over the years.

This letter responds to your December 2, 2020, December 16, 2020, and December 18, 2020
emails about your claims, and follows-up on our December 16, 2020 letter to you.


Please refer to our October 21, 2020 and November 18, 2020 letters for our position regarding
your contentions of misconduct and mishandling of your claims. We disagree with all of your
repeated and new allegations of improper actions by us and maintain that we paid you all that is
owed contractually to you on both claims. In addition, we handled your claims in keeping with
our duty of good faith and fair dealing.


We did not damage your home. If you believe you need an “estimate for rebuild,” you should
proceed as you deem necessary. However, our determination remains that we paid you all of
the claim benefits under the policy’s applicable coverages, including enough to restore your
house to its pre-loss condition and the policy’s limit for mold-related costs (twice). While at this
time we do not plan to obtain an estimate, we would review and evaluate anything you submit
on your claims.


You write about a potential refinancing with FrontWave Credit Union and that “an appraisal
seems mandatory.” The need for a fair market value appraisal is an issue between your lender
and you and we would not be involved in that process. Please clarify if we are misinterpreting
your “appraisal” reference.


I (Claim Team Manager Roy Paynter) am the State Farm employee with direct management
authority over this claim and I have sufficient authority on your losses, in conjunction with
Section Manager Mike Piha. For that reason, State Farm declines to “elevate” the claims to
another manager.


As we have written to you multiple times, you (not State Farm or any person working for State
Farm such as Randy Brewer, Linda Holloway-Cox, and others) hired the remediation and repair
entities (e.g. ServPro, American Environmental, Paul Davis Restoration, and Michael Savage
Construction); authorized their work; and were responsible for any termination, dismissal, or
replacement of them. We did not coerce, mislead, or deceive you in any way on your claims.
We cannot resolve your numerous conflicts with your various vendors, which are subjects of
your draft complaint.


We do not know of any “State Farm litigation” with you, although you have warned us of a
potential lawsuit – your residency during a legal case is your choice, and we will not pay for it.
At this time, State Farm does not intend to pursue subrogation related to its payments on these
claims. If you believe third parties are liable for damage to your home, you may have legal
rights to seek payment from those third parties.


You have again told us that you might record our telephone conversations. We continue to
object to any such recordings and believe that it is unlawful for you to record without our
consent. Because you write that you might record without any further notice, all of the future
communications between us must be in writing.


In our November 18, 2020 letter, we stated our position on the one-year period in the policy’s
“Suit Against Us” condition. The one-year period continues to run.


We are required by California law to advise you that if you believe this claim, or any part of this
claim, has been wrongfully denied or rejected, you may have the matter reviewed by the
California Department of Insurance, Claims Service Bureau, 300 South Spring Street, Los
Angeles, California 90013, telephone 1-800-927-4357.


We reserve all of our rights under the policy and law and waive none of them.
