Dear Roy Paynter and Involved Vendors and Interested Parties and Leadership (if any names have been inadvertently omitted, kindly forward to your colleagues or legal departments)
Attached is an excel spreadsheet showing dates the property was inspected, who it was inspected by, which vendors, document dates and time, price lists, replacement cost values; IT IS ALSO PASTED BELOW FOR YOUR CONVENIENCE
You will notice that all the xactimate documents were delivered to the adjuster, Randy Brewer, who handled all the communications, negotiations,
authorizations with the assigned vendors. ContractorConnection assigned Paul Davis Restoration as the General Contractor and PDR also served as
the “Adjuster Rep” on behalf of State Farm. While PDR insists they were never assigned as General Contractor and only inspected the property regularly
during February because, as the General Manager stated in a face to face meeting earlier this year, “Rod was just hanging out looking for a project.”
Please note that Rod Pankratz acted as the General Contractor and Adjuster Rep, and it is my understanding he is licensed for neither of those positions.
I think he’s the sales guy, per the GM’s comments in the visit earlier this year. They allege all they did was the packout (which destroyed all the home contents
that were rained on for approximately 10 days, and were boxed up in to dirty used boxes, with high risk of cross-contamination of all goodes, as well as all rooms the boxes were later moved to from the container pod…. THE DESTRUCTION OF THE PACK OUT/ BOX OUT IS NOT THE POINT OF THIS COMMUNICATION. PDR IS SUING ME IN SMALL CLAIMS COURT FOR $5,000 — they cannot seem to determine just how much they spent to destroy my home in their efforts to escalate a simple roof blow off into a larger build-back. Because of the months and months of microbial growth, one hygeniest suggested that when the matter settles, bulldoze the house because with the toxic exposure, I will never be safe here again.
I digress.
Please look at the xactimate documents…. and note the dates inspected, by whom, and since Roy Paynter and the Phoenix State Farm Office have copies of all these xactimate documents, it should be easy to see that the Contractor Connection and State Farm dispatched vendors took no legitimate actions to mitigatelosses and in fact, caused extreme catastrophic water intrusion— rain and snow pouring into my home for weeks.
A fast look at the ServPro 9 page xactimate documents certainly does not cover 40 days of water intrusion, nor does it even cover the alleged 17 days they worked on the project.
Paul Davis Restoration was the assigned General Contractor and “Adjuster Representative” repeatedly from February 4, 2019 through approximately March 8, 2019. All authorizations and negotiations were done by PDR and ServPro directly with State Farm Adjuster, Randy Brewer. They would take no directions from me, and clearly took directions only from Randy Brewer. Even the negotiations for the above referenced pack-out were illegitimately negotiated with Randy Brewer.
As Roy knows, documentation from Randy Brewer was recently discovered from March 2019, advising the insured that participation in the Preferred Vendor as voluntary (CONTRARY TO ALL PREVIOUS COMMUNICATIONS AND ACTIONS, AND BY MID-MARCH, THE CATASTROPHIC DAMAGES CAUSED BY CONTRACTOR CONNECTION, PAUL DAVIS RESTORATION, AND SERVPRO, APPARENTLY APPROVED BY RANDY BREWER, WERE ALREADY DONE. IN MARCH 2019, RANDY BREWER CONTACTED AMERICAN ENVIRONMENTAL GROUP FOR ENVIRONMENTAL TESTING AND MOLD CLEARANCE. AGAIN, ALL NEGOTIATIONS WERE DONE BY STATE FARM AND VENDORS, AND THE INSURED WAS EXCLUDED UNTIL AFTER THE FACTS.

Here is an excerpt from communications with Roy Paynter and the Department of Insurance Compliance Officer. Roy will need to hear from you directly on how you wish to proceed, as he must send a corrected determination to the DOI, with this, and other evidence apparently missing from his files, but that I have cordially provided for his esteemed investigations. We all hope that this can be settled without litigation, before year end. So y’all might want to talk amongst one another. I’m no insurance pro, but y’all might want to pitch in your respective shares (to save State Farm subrogation litigation costs also).
I have repeatedly requested that the adjuster return to the property.
IF ONLY THEY HAD SIMPLY DENIED THE CLAIM, I WOULD BE SAFE AND MY HOME WOULD NOT HAVE BEEN DESTROYED. I WOULD HAVE BEEN MAD, BUT IT WOULD NOT HAVE LOST EVERYTHING. I WOULD HAVE CALLED A LOCAL ROOFER… coincidentally, the same one Paul Davis Restoration called– I used to sell real estate in town…. you might think I know a little bit about real estate, and who to call. STATE FARM DECEIVED ME AND TOLD ME I WAS REQUIRED TO USE THEIR VENDORS. HENCE, THE DISASTER BEGAN.
Note also that the actual State Farm adjuster did not inspect the property until mid-March 2019, and then again in November 2019. Are you beginning to connect more dots?
You might have your xactimate team look at all documents that were sent to me and see if they can make sense, at least for subrogation. You do also realize that all negotiations with Contractor Connect, Paul Davis Restoration, ServPro, Temporary Accommodations and American Environmental Group were done with “the client” — RANDY BREWER ON BEHALF OF STATE FARM, and not one of them would negotiate with me (until Paul Davis in early summer asked me to participate in some insurance fraud (WHICH I REFUSED!) to get him some of the money they fraudulent charged for to destroy my home and AMERICAN ENVIRONMENTAL GROUP in August 2019, when I called them back to complete the house inspection they started in March 2019. Both reports appear quite fraudulent, the second building on the deceptions of the first, and seem aimed to protect the damages caused by the aforementioned parties.
If you compare the period of time that the house was without a roof, you’ll see that none of the xactimates could possibly be accurate, confounded by the poorly done environmental reports March and August 2019, and all those before and after those dates, in efforts to identify the consequences of the identified but unremediated water damaged walls, sheathing and insulation. Nasty stuff. THE DELAYS CAUSED BY NO FAULT OF THE INSURED ARE THE PROXIMATE CAUSE OF THE CATASTROPHIC DAMAGE. TIME TO PAY UP.
The second contractor, Savage Contraction, was authorized by the State Farm field adjuster in March 2019, and she provided the scope of authorized work to Savage Construction. Unfortunately, it looks like some of the xactimates indicates sheathing was compromised and was to have been torn off, which was apparently not completely done, and in most professional opinions, NEEDS TO BE TORN OFF BEFORE BUILD BACK CAN BEGIN. BUILD BACK IS ALSO DELAYED BECAUSE OF REMAINING VISIBLE AND DETECTED MOLD IN SHEATHING, JOISTS, BEAMS AND CONTAMINATED SURFACES FROM FEB/MAR INCOMPLETE REMEDIATION EFORTS.
Still looking for legal representation but it is beginning to look hopeful that Roy and his colleagues and superiors are beginning to understand what really happened, and I have hope that right action and resolution is forthcoming. Ideally, before November 3, 2020, and certainly before year end.
The RESTORATION INDUSTRIES ASSOCIATION is currently having a national virtual event to deal with things including how contractors are cheated by the price fixing of xactimate, and apparently they are also offering trianing (ie. look at all these xactimates and you can see part of the problem… maybe it’s not all fraud, maybe some of it was tech… Rod said Contractor Connection made him re-do the estimate that caused further delay in February…
The Paul Davis Restoration 3/5/2019 6:26 am xactimate document incompletely and therefore inaccurately states:
“High winds pulled 65% of BU Roofing from roof and subsequent water from rain caused substantial water damage to the inteior of the living room, Bedroom, Den and Walk in Closet.” What PDR leaves out is emphasis that THE DATE OF LOSS WAS 2/2/2019 AND THE SUBSEQUENT WATER DAMAGE WAS CAUSED BY STATE FARM AND PREFERRED VENDOR FAILURES AND DELAYS TO INSTALL PROPER TARP AND THEY DID NOT REPLACE THE ROOF FOR OVER 40 DAYS OF CONTINUED TORRENTIAL RAINS, WIND, SNOW AND CONSEQUENT WATER INTRUSION. Just look at the dates of the inspections and estimates… and review previously sent emails. The roof was not replaced until mid-March 2019, not all the sheathing was replaced, and……the rest will be handled with CSLB and the Courts, as required, unless Roy can roll it all in together, since Linda Holloway Cox authorized Savage, when I was still under the deception that the change from PDR to any other contractor required field adjuster authorization if not another Preferred Vendor. So complicated. It looks like some internal problems….. I’ve suffered more than enough because of these “mistakes”….

The NAIC is apparently awaiting further complaint details involving various states involved in the apparent mistakes if they are not corrected. shortly. I am hopeful that Roy and his team can help with that, too. The new adjuster is Mathew, but he doesn’t return calls, so Roy is our guy. Let’s fix this now. Let’s do it for America!
